Terms and Conditions

By accessing and using Yidemak's services (hereinafter "we", "our" or "us"), you agree to be bound by these terms and conditions. If you do not accept any of these terms, you should not use our services. These terms apply to all visitors, users and other persons who access or use our services, including our website, applications and any other digital platform we operate.

Yidemak provides web and mobile development services, application design, SaaS solutions, cybersecurity, artificial intelligence and digital consulting. We reserve the right to modify, suspend or discontinue all or part of our services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension or discontinuation of services.

All content on our platforms (text, images, logos, source code, designs) is the exclusive property of Yidemak or its licensors and is protected by French and international intellectual property laws. You may not copy, modify, distribute, sell or rent any part of our services or content without our prior written permission. Any unauthorized use may result in legal action. For client projects, intellectual property of deliverables is transferred to the client after full payment, unless otherwise stated in the contract.

You agree to: • Use our services legally and ethically • Not attempt unauthorized access to our systems • Not introduce viruses, malware or any malicious code • Not use our services for fraudulent or illegal activities • Provide accurate and up-to-date information in your interactions with us • Respect third-party intellectual property rights Any violation of these obligations may result in immediate suspension of your access to our services and legal action.

Our service rates are quoted in euros (€) and are valid at the time of contract signing. We reserve the right to modify our rates at any time for future contracts. Standard payment terms are: • 30-40% deposit upon signing • 30% at project midpoint • Balance upon final delivery Invoices are payable within 30 days of issue, unless otherwise agreed. Any late payment will incur late payment penalties at 3 times the legal interest rate, plus a fixed recovery fee of €40.

Yidemak makes every effort to provide quality services. However, we do not guarantee that our services will be uninterrupted, error-free or virus-free. Our liability is limited to the amount paid by the client for the service in question. We are not liable for indirect, incidental, special or consequential damages resulting from the use or inability to use our services. This limitation does not apply in cases of gross negligence, fraud or breach of essential contract obligations.

We are committed to maintaining the confidentiality of all sensitive information you provide to us in our collaborations. Our teams are bound by strict confidentiality agreements. We do not disclose any confidential information to third parties without your prior written consent, except as required by law. All our projects include a 3-month warranty after delivery covering bugs and malfunctions related to our code. This warranty does not cover: • Modifications made by the client or third party after delivery • Problems resulting from misuse • Failures due to external factors (hosting, third-party APIs) • New features not included in the initial scope Any warranty claim must be made in writing with a detailed description of the problem.

Either party may terminate a contract with 30 days' written notice, except in cases of substantial breach of contract terms. In case of early termination by the client, worked hours will be billed pro-rata. Amounts already paid remain acquired for work performed. We reserve the right to immediately suspend or terminate access to our services in case of serious breach of these terms, without notice or refund.

We reserve the right to modify these terms and conditions at any time. Modifications will take effect upon publication on our website. We will notify you of significant changes by email. Your continued use of our services after such changes constitutes your acceptance of the new terms. It is your responsibility to regularly review these terms to stay informed of any changes.

These general terms are governed by French law. Any dispute relating to the interpretation or performance of these terms shall be submitted to the competent courts of Paris, France. In case of dispute, the parties will endeavor to find an amicable solution before any legal action. If no agreement is reached within 30 days, the dispute may be brought before the competent courts. If any provision of these terms is found invalid or unenforceable, the other provisions shall remain in effect.
